If there is no trash pickup there then no, they cannot collect for services that they are not performing.

It is legal. It is illegal however to not have waste management. Their job is to keep the the town and in a bigger sense the environment clean, they don't know or care if your house is vacant or not.

Contact the city manager and inquire. There may be a city ordinance requiring all property owners to maintain a contract for refuse pick up. If that's the case, then it would be legal. The fact that the city doesn't maintain it's own sanitation department and equipment isn't really relevant.

Yes, sadly, it is legal. While the city does not employ waste collection to all city residential lots — it has contracted for such collection to lots.

I suggest that you pay your bill and any fines, then work with other citizens to change the city law such that individuals would be required to contract with independent waste haulers for their refuse removal. This would be pro-small business and would reduce rates on waste — WM has purchased a monopoly from you city elders.
