cancel management contract with poor estate agent?
Hello, I signed a contract with a estate agent which turns out to deliver very poor service and does not do his job regarding the property maintenance, resulting in very upset tenants and a bathroom leak which impacted the flat below for 2 months.
The contract states I should give 3 months notice before exiting, but I’d like to replace this agency with another right now. Am I legally allowed to do so?
Go to the tenants and put that you will take over the management of the flat until the 3 months are over, then you will pass it on to a new agent or poss keep it yourself. If they are happy with that get them to pay the rent directly to you, and contact you not the agent. Keep this between yourself.
Contact the agent and give them 3 months notice, if they are not getting anything in rent, they can not get any further charges from you. At the end of 3 mths they may be difficult, but just tell them to invoice you, and then dispute it.
You’ll have to check with a legal agent / expert to look over the contract (i.e. lawyer / solicitor).
I would think, if they have failed to perform AS DELINEATED IN THE CONTRACT, you will have the right to break contract, but you will have to prove they did not perform as agreed.
Good luck.

I’d agree, you need to consult a solicitor over your options in this case. There should be a mechanism in the contract regarding nonperformance, but it does need a close look.

I came across a case similar to this where a Tenant’s contractual obligations where not being met by a housing association
They got advice from their local county council, who told them they where legally able to hold back rent because they broke the Tenant agreement
So based on that I would say yes, best thing to do is ask the citizens advise or similar body (so you don’t loose your bond)

No chance.
They will sue your ass off and you will wish you had
never been born.
I hope this helps.
