I live in a mobile home park under a lot rent contract. The management refuses to fix the street conditions.?
The contract CLEARLY states that the management company will be responsible for maintaining the "shared" and "public" roadways and streets (i.e.: neighborhood streets, entrance and exit ways); however, this is the second year that we have dealt with pitted roads that are speckled with deep pot-holes, some are nearly "sink-hole" depth and size! There is no way to avoid them as they are on both sides of the road and cars are being put through extreme wear and tear just driving through here. I have already contacted the property manager and she just claims there is no money to fix the roads, but we all pay about $400-$500 a month in lot rent alone. I have tried to file a complaint with the management company directly, but all I have is a P.O. Box address and nobody will give me a contact person or number – they don’t respond. Who should I be reporting this to? The city? The state? Anyone have any idea who I should contact about this and failure to uphold contract terms/conditions? I know that I can consult an attorney and file suit, but a) that would cost ME money and b) all that could be done is the roads being ordered to be fixed… I feel another department or agency could order that same thing without me having to pay an attorney and file a case in court. Any ideas? Thanks!
I can not think of any agency that would get involved without this going to court. You are basically saying that you think the company is in breech of contract, and they likely are. However, you need a judge to agree with you, no one else can legally determine if there is a breech or not.

No agency is going to get involved in this situation, since the roads at issue are privately owned by the mobile home park. This is an issue between ownership and tenants. Your ‘public roads’ have the same status as does a driveway on a rented house.
If you feel strongly enough about this, you will have to bring legal action on your own, through an attorney of your own. And DO remember that ‘lot rents’ are not fixed in stone. If you legally force repairs, you may well end up paying for the repairs through increased lot rents.
